To tackle the fast-moving challenges of our age, law and policymaking must become more flexible, evolutionary and agile. Thus, in this Essay we examine ‘crowdlaw’, namely how city councils at the local level and parliaments at the regional and national level are turning to technology to engage with citizens at every stage of the lawand policymaking process. Aswe hope to demonstrate, crowdlaw holds the promise of improving the quality and effectiveness of outcomes by enabling policymakers to interact with a broader (...) public using methods designed to serve the needs of both institutions and individuals. crowdlaw is less a prescription for more deliberation to ensure greater procedural legitimacy by having better inputs into lawmaking processes than a practical demand for more collaborative approaches to problem solving that yield better outputs, namely policies that achieve their intended aims. However, as we shall explore, the projects that most enhance the epistemic quality of lawmaking are those that are designed to meet the specific informational needs for that stage of problem solving. The resuscitation of deliberative democracy in the Information Age requires the construction of transparent public spaces ‐ public arenas where power relationships between speakers are discernible and debate ensues according to the rules of civility and reason (conversational transparency). The metaphor of transparency, in the sense of legal accountability, also connects the role of communications regulation to the development of democratic political culture (legal transparency). This paper presents an experimental study investigating artificial grammar learning (AGL) in monolingual and bilingual children, with and without dyslexia, using an original methodology. We administered a serial reaction time (SRT) task, in the form of a modified Simon task, in which the sequence of the stimuli was manipulated according to the rules of a simple Lindenmayer grammar (more specifically, a Fibonacci grammar). By ensuring that the subjects focused on the correct response execution at the motor stage in presence of (...) congruent or incongruent visual stimuli, we could meet the two fundamental criteria for implicit learning: the absence of an intention to learn and the lack of awareness at the level of resulting knowledge. The participants of our studies were four groups of 10-year-old children: 30 Italian monolingual typically developing children, 30 bilingual typically developing children with Italian L2, 24 Italian monolingual dyslexic children and 24 bilingual dyslexic children with Italian L2. Participants were administered the modified Simon task developed according to the rules of the Fibonacci grammar and tested with respect to the implicit learning of three regularities: (i) a red is followed by a blue; (ii) a sequence of two blues is followed by a red and (iii) a blue can be followed either by a red or by a blue. Results clearly support the hypothesis that implicit learning took place, since participants of all groups became increasingly sensitive to the structure of the input, implicitly learning the sequence of the trials and thus appropriately predicting the occurrence of the relevant items, as manifested by faster reaction times in predictable trials. Moreover, group differences were found, with bilinguals being overall faster than monolinguals and dyslexics less accurate than controls. Finally, an advantage of bilingualism in dyslexia was found, with bilingual dyslexics performing consistently better than monolingual dyslexics and, in some conditions, at the level of the two control groups. These results are taken to suggest that bilingualism should be supported also among linguistically impaired individuals. (shrink)

This book presents a comprehensive overview of the sum rule approach to spectral analysis of orthogonal polynomials, which derives from Gábor Szego's classic 1915 theorem and its 1920 extension. Barry Simon emphasizes necessary and sufficient conditions, and provides mathematical background that until now has been available only in journals. Topics include background from the theory of meromorphic functions on hyperelliptic surfaces and the study of covering maps of the Riemann sphere with a finite number of slits removed. This allows for (...) the first book-length treatment of orthogonal polynomials for measures supported on a finite number of intervals on the real line. In addition to the Szego and Killip-Simon theorems for orthogonal polynomials on the unit circle and orthogonal polynomials on the real line, Simon covers Toda lattices, the moment problem, and Jacobi operators on the Bethe lattice. Education as identity formation in Western-style liberal-democracies relies, in part, on neutrality as a justification for the reproduction of collective individual identity, including societal, cultural, institutional and political identities, many aspects of which are problematic in terms of the reproduction of environmentally harmful attitudes, beliefs and actions. Taking a position on an issue necessitates letting go of certain forms of neutrality, as does effectively teaching environmental education. We contend that to claim a stance of neutrality is to claim a position (...) beyond criticism. In the classroom this can also be an epistemically damaging position to hold. To further explore the problem of neutrality in the classroom, and to offer a potential solution, we will look to the philosophical community of inquiry pedagogy, and advocate for the addition of place-based education; a form of experiential education that promotes learning in local communities in which the school is situated, each with its own history, culture, economy and environment. However, how we understand ‘place’ is fundamental to understanding the potential of place-based education in giving students a ‘sense of place’—how they perceive a place, which includes place attachment and place meaning. To this end, we look to Indigenous understandings of Place and social reconstruction learning to inform place-based pedagogies. Doing so, we hold, opens a pathway to ethical education. (shrink)

The struggle to become lucid is at the heart of The Myth of Sisyphus. To understand the absurd is to understand that the fit between our conception of the world and the world itself is fraught with uncertainty; lucidity is the elucidation of the absurd. To be lucid is to revolt against the type of certainty that leads to suffering; to revolt against philosophical suicide. Camus teaches us the intellectual humility that stays hands; there is no reasoning that justifies suffering. (...) If it is granted that the ability to recognise and respond to our own and others suffering is an important part of being human, and the task of education is to develop humans, then lucidity, in so far as it holds promise for the development of such an ability, has the potential to contribute positively to education. This paper aims to integrate insights from psychoanalytic theory into business ethics research on the sources of ethical failures within organizations. We particularly draw from the analysis of sources and outcomes of neurotic processes that are part of human development, as described by the psychoanalyst Karen Horney and more recently by Manfred Kets de Vries; we interpret their insights from a stakeholder theory perspective. Business ethics research seems to have overlooked how “neurotic management styles” could be the antecedents of unethical (...) behavior within organizations. After showing the connection between five managerial neuroses and the corresponding potential ethical failures within organizations that have been already identified within business ethics research, we suggest three organizational strategies to counteract these failures. First, we argue that managers should pay greater attention at the complexity of human motivation, avoiding the simplistic view of compliance‐based approaches. Second, we discuss the importance of developing a conversation around values within organizations, enabling healthy individual growth and limiting the emergence of neurotic processes. Finally, we discuss the role of the business ethicist in facilitating such a process, suggesting a parallel between the role of the business ethicist and that of the psychoanalytic therapist. ABSTRACTSkepticism about citizen competence is a core component of Christopher H. Achen and Larry M. Bartels’s call, in Democracy for Realists, for rethinking our model of democracy. In this paper I suggest that the evidence for citizen incompetence is not as clear as we might think; important research shows that we are good group problem solvers even if we are poor solitary truth seekers. I argue that deliberative democracy theory has a better handle on this fundamental fact of human cognition (...) and therefore has a more realistic view of the conditions that might improve citizen competence. As the purpose of this book is to open dialogue, we draw no conclusions. Instead, reflecting on the theoretical and practical implications that arise from each chapter, we offer some reflection through an exploration of the ways in which Australia has broadened discussions on P4C. In addition, we situate our discussion in contemporary global issues relevant to education and schooling: gender stereotyping, bias and language; Aboriginal philosophy; environmental education; and sexuality, adolescence and discrimination. As a community of children, adolescents and (...) adults, philosophers and educators, as well as citizens, we have an opportunity to contribute educationally to an inquiring society. (shrink)

Two views on the nature and location of pain are usually contrasted. According to the first, experientialism, pain is essentially an experience, and its bodily location is illusory. According to the second, perceptualism or representationalism, pain is a perceptual or representational state, and its location is to be traced to the part of the body in which pain is felt. Against this second view, the cases of phantom, referred and chronic pain have been marshalled: all these cases apparently show that (...) one can be in pain while not having anything wrong in her body. Pain bodily location, then, would be illusory. I this paper I shall defend the representational thesis by presenting an argument against experientialism while conceding that the appearance / reality distinction collapses. A crucial role in such identification is played by deictics. In reporting that we feel pain here, the deictic directly refers to the bodily part as coinciding with the part as represented. So, pain location is not illusory. The upshot is that the body location is part and parcel of the representational content of pain states, a representation built up from the body map. (shrink)

Inherent in providing healthcare for youth lie tensions among best interests, decision-making capacity, rights, and legal authority. Transgender youth experience barriers to needed gender-affirming care, often rooted in ethical and legal issues, such as healthcare provider concerns regarding youth capacity and rights to consent to hormone therapy. Even when decision-making capacity is present, youth may lack the legal authority to give consent. The aims of this paper are therefore to provide an empirical analysis of minor trans youth capacity to consent (...) to hormone therapy and to address the normative question of whether there is ethical justification for granting trans youth the authority to consent to this care. Through qualitative content analysis of interviews with trans youth, parents, and healthcare providers, we found that trans youth demonstrated the understandings and abilities characteristic of the capacity to consent to hormone therapy and that they did consent to hormone therapy with positive outcomes. Employing deontological and consequentialist reasoning and drawing on a foundation of empirical evidence, human rights, and best interests we conclude that granting trans youth with decisional capacity both the right and the legal authority to consent to hormone therapy via the informed consent model of care is ethically justified. We present a syntactical cut-elimination proof for an extended sequent calculus covering the classical modal logics in the \(\mathsf{K}\), \(\mathsf{D}\), \(\mathsf{T}\), \(\mathsf{K4}\), \(\mathsf{D4}\) and \(\mathsf{S4}\) spectrum. We design the systems uniformly since they all share the same set of rules. Different logics are obtained by “tuning” a single parameter, namely a constraint on the applicability of the cut rule and on the (left and right, respectively) rules for \(\Box\) and \(\Diamond\). Starting points for this research are 2-sequents and indexed-based calculi (...) (sequents and tableaux). By extending and modifying existing proposals, we show how to achieve a syntactical proof of the cut-elimination theorem that is as close as possible to the one for first-order classical logic. In doing this, we implicitly show how small is the proof-theoretical distance between classical logic and the systems under consideration. (shrink)

Scholars, policymakers and organizations in the EU, especially at the level of the European Commission, have turned their attention to the ethics of (trustworthy and human-centric) Artificial Intelligence (AI). However, there has been little reflexivity on (1) the history of the ethics of AI as an institutionalized phenomenon and (2) the comparison to similar episodes of “ethification” in other fields, to highlight common (unresolved) challenges.Contrary to some mainstream narratives, which stress how the increasing attention to ethical aspects of AI is (...) due to the fast pace and increasing risks of technological developments, Science and Technology Studies(STS)-informed perspectives highlight that the rise of institutionalized assessment methods indicates a need for governments to gain more control of scientific research and to bring EU institutions closer to the public on controversies related to emerging technologies.This article analyzes how different approaches of the recent past (i.e. bioethics, technology assessment (TA) and ethical, legal and social (ELS) research, Responsible Research and Innovation (RRI)) followed one another, often “in the name of ethics”, to address previous criticisms and/or to legitimate certain scientific and technological research programs. The focus is on how a brief history of the institutionalization of these approaches can provide insights into present challenges to the ethics of AI related to methodological issues, mobilization of expertise and public participation. The problem of free will lies at the heart of modern scientific studies of consciousness. Some authors propose that actions are unconsciously initiated and awareness of intention is referred retrospectively to the action after it has been performed [e.g. Aarts, H., Custers, R., & Wegner, D. M. . On the inference of personal authorship: Enhancing experienced agency by priming effect information. Consciousness & Cognition, 14, 439–458]. This contrasts with the common impression that our intentions cause those actions. By combining a (...) stop signal paradigm and an intentional action paradigm we show that participants sometimes indicate to have intentionally initiated an action while reaction time data strongly suggest that they in fact failed to stop the action. In a second experiment we demonstrate that the number of trials in which participants misattributed their awareness of intention varied with the intentional involvement during action planning. Our data support the retrospective account of intentional action. Furthermore, we introduce an experimental approach that objectifies introspective judgments of awareness of intention. (shrink)

We propose that procedures of separation have two functions, namely first, to establish the integrity of individual parts, and second, to make previously joint entities discreet and therefore countable. This allows taking stock of available resources, including evaluating the use of individual objects, a process that is especially adaptive under conditions of threat of contagious disease and resource scarcity.

Phenomenology and structuralism are commonly understood as two opposing and largely incompatible schools of thought. Indeed, if the former is thought of as the philosophy of subjectivity par excellence, and the latter as the tradition in which the “death of man” is declared, it seems difficult to challenge the antagony between them. On closer inspection, however, it becomes clear that this picture represents an oversimplification and turns out to be, to a great extent, fallacious. The aim of this paper is (...) to show that the philosophy of the early Husserl – notably as exposed in the Logical Investigations – ought to be fully considered as both part of the wide tradition of Transcendental philosophy as well as Structuralism. To this end, the paper mainly addresses Husserl’s notion of Wissenschaftslehre and the mereology developed in the Third logical investigation and, as a result, tries to show how Husserl’s position can be defined in terms of a “phenomenological structuralism” or a “structural phenomenology” or, as I propose, a “transcendental structuralism”.
